What Adero Canyon's governing documents say
Adero Canyon is a master-planned community in Fountain Hills, AZ. This Declaration of Covenants, Conditions and Restrictions (CC&Rs) sets the baseline rules for the entire community, including single-family homes, cluster housing, and condominium developments. It binds all owners, residents, and the homeowners association (the 'Association').
- Assessments & fees: Owners must pay Regular, Individual, Special, Subdivision, and Reconstruction Assessments. The annual Regular Assessment cannot increase more than 20% from one year to the next without a majority vote of Class A Members. The Board may also impose a transfer fee on new owners (up to two months of the Regular Assessment) and an administrative fee after the fourth anniversary of the first lots being assessed.
- Voting rights & developer control: There are two membership classes: Class A (lot owners) with one vote per lot, and Class B (the Developer) with five votes per lot. Until the Transition Date (when 95% of lots are sold to retail buyers), the Developer appoints the Board and controls most decisions. After transition, certain major decisions require member approval.
- Major decisions requiring member approval: After the Transition Date, the following require a member vote if 10% or more of the total vote objects within 45 days: amending use restrictions (Exhibit B), capital improvements over 10% of budget, selling common area, borrowing money, imposing certain fees, levying Special Assessments, annexing property, and de-annexing (except for developer-owned land).
- Architectural review: A Design Committee appointed by the Board enforces Design Guidelines. Owners must submit plans for approval before making any exterior changes. The committee has the power to charge fees, require bonds or deposits, and inspect work. Its decisions are subject to appeal.
- Enforcement & fines: The Association and Developer may enforce the Governing Documents through legal action, injunctions, or fines. The Board can suspend a violator's common-area use and voting rights for up to 60 days per infraction. The violating owner is personally liable for all enforcement costs, including attorneys' fees.
