What Coyote Canyon's governing documents say
This is a deed restriction recorded on a parcel (the 'Burdened Property') adjacent to the Coyote Canyon single-family subdivision (the 'Benefited Property'). It limits how the parcel can be developed, primarily to protect views and character for Coyote Canyon homeowners. The restrictions run with the land and bind all future owners of the Burdened Property.
- Maximum number of homes: No more than 10 single-family detached homes may be built. Duplexes, townhomes, and condominiums are prohibited. Attached or detached casitas (mother-in-law units) are allowed.
- Building height limit: No building or structure may exceed 21.5 feet in height, measured from the finished floor elevation shown on the site plan to the highest point.
- Setback from Coyote Canyon: Every lot on the Burdened Property must be set back at least 61 feet from the boundary with the Coyote Canyon subdivision.
- Access road: The access road location and configuration must match the approved site plan. If the city doesn't approve it, the developer, city, and Coyote Canyon HOA must agree on an alternative.
- Duration and modification: The restrictions are perpetual and can only be changed with written agreement from both the HOA and the current owner of the Burdened Property.
- Enforcement: The Coyote Canyon HOA, its members, and the landowner can enforce these restrictions through legal action. The prevailing party in any lawsuit recovers costs and attorney's fees.
- Contingency: This document only takes effect if the City of Scottsdale approves a specific zoning case for 10 lots on the Burdened Property, and that approval survives any appeals or referendums.
