Fountain Hills Hamilton Condominiums is a 5-unit condominium community in Fountain Hills, AZ. Each unit owner owns a 20% interest in the common area. The declaration binds unit owners and residents, outlining rules on leasing, pets, parking, architectural changes, and assessments. This is a conversion from a former multi-family rental property.
- What you own & maintain: You own your individual dwelling unit (including a garage, which is a limited common area). The association maintains the common areas, including private streets and drainage facilities, and carries master insurance. Each unit owner has a 20% undivided interest in the common area.
- Leasing & rentals: Leases must be in writing for an initial term of at least six months. The board also has the right to prohibit leasing entirely to protect the residential character. Lessees must comply with the declaration, and the board may act on the owner's behalf to enforce rules.

- Assessments & fees: The association levies annual general and special assessments. A working capital contribution of two months' assessments is required at closing. There is a repair and replacement reserve for common areas, especially for private roads inspected every three years. Assessments are a lien on the unit, subordinate only to first mortgages. Delinquent assessments incur interest, late fees, and potential foreclosure.
