Cambria Condominiums LIV is a two-unit residential condominium in Fountain Hills, AZ where you own your individual unit and share ownership of common elements, which the association maintains and insures. Unit owners are responsible for maintaining their own units and are subject to architectural approval for external modifications and compliance with both the Condominium Documents and Town of Fountain Hills restrictions.
- What you own & maintain: You own your unit (bounded by exterior perimeter walls, roof/parapet, floor slab, and party walls to their midline). The association maintains common elements; you're responsible for maintaining your unit's interior and any allocated limited common elements like your yard and patio.
- Single-family residential use only: Units are restricted to single-family residential use — no commercial businesses, professions, trades, or gainful occupations. You may maintain personal professional records or handle personal business calls from your unit.
- Modifications & architectural approval: Non-structural interior changes don't need approval, but you're liable for any damage to the adjoining unit or common elements. Structural additions, color/texture changes, and all external modifications require prior written approval from the adjoining unit owner. The property is subject to Fountain Hills Committee of Architecture; if rules conflict, the more restrictive rule applies.
- Restricted vehicles, machinery & equipment: Motor vehicles cannot be serviced or repaired if visible from neighboring property, and inoperable vehicles cannot be stored or parked if visible. No other machinery or equipment (except standard building/maintenance equipment) may be placed or operated on the property.
- Other prohibited uses: No clotheslines or exterior clothes-drying facilities, mineral exploration, or outside speakers/horns/whistles (except emergency devices). Trash must be in covered approved containers; no incinerators in units. No nuisances, diseases, insects, or unlawful activities are permitted.
- Assessments & financial obligations: Common expenses are assessed equally among all units. Assessment liens are subordinate to mortgages — if a lender forecloses, assessments that became payable before foreclosure are extinguished and may be reallocated to remaining units.
- Insurance requirements: Unit owners must maintain fire, casualty, and liability insurance on their unit at full replacement value. Minimum liability coverage is $500,000 per unit (joint with adjoining unit owner unless a larger amount is specified); you must provide evidence of insurance to the adjoining unit owner.
- Leasing & tenant liability: Units may be leased; however, you remain responsible for ensuring that your tenants, guests, and invitees comply with all provisions of the Condominium Documents.
