Tuscany at Cambria Condominiums is a two-unit condominium community in Fountain Hills, AZ. You own your individual unit and an undivided 1/2 interest in the common elements. The association maintains the common elements and carries master insurance; you maintain your unit and limited common elements. This declaration applies to unit owners and occupants.
- What you own & maintain: You own the interior of your unit and are responsible for its maintenance and repair, including interior surfaces, fixtures, and any limited common elements like driveways or parking spaces allocated to your unit. The association maintains the common elements, including roofs, exterior walls, landscaping, and common areas.
- Assessments & fees: Annual assessments are set by the board based on an adopted budget and are payable in installments as determined by the board. Special assessments require approval of 3/4 of votes present at a member meeting. Delinquent assessments accrue interest at 12% per annum (or VA loan rate, if higher) plus late fees and can become a lien on the unit. Assessments are allocated equally among units (1/2 each).
- Insurance: The association must carry property insurance on common elements (at least 80% actual cash value) and liability insurance (minimum $1,000,000 per occurrence).
