Javelina Heights is a 2-unit condominium in Fountain Hills, AZ. This declaration establishes the rules for owning and living in a unit. All unit owners share the building and must follow the restrictions and maintenance obligations detailed below.
- What you own & maintain: You own your unit's interior and certain limited common elements (e.g., yard, patio, exterior doors/windows). You must maintain these at your own expense. The association maintains the common elements (building structure, common areas).
- Use & occupancy: Each unit must be used as a single-family residence. No business, no nuisance, no outdoor clotheslines, no visible vehicle repairs, and no storage of inoperable vehicles. Trash must be in covered containers approved by the town.
- Alterations & architecture: Nonstructural interior changes are allowed without approval, but any structural addition, alteration, or exterior modification requires prior written consent of the adjacent unit owner. All changes must also comply with the architectural committee and the Fountain Hills Committee of Architecture.
- Insurance: Each unit owner must carry fire, casualty, and liability insurance on their unit for full replacement value. Each owner must also ensure that together both units have at least $500,000 in liability coverage, and provide proof to the other owner.
- Assessments: Common expenses are split equally between the two units (50% each). The board sets a budget and owners pay monthly assessments. Late penalties may apply. Assessment liens are subordinate to first mortgages.
- Dispute resolution: Disputes between unit owners require a 21-day negotiation period. If unresolved, the matter goes to binding arbitration (arbitrator selected by court if parties cannot agree).
- Duration & amendment: The declaration runs for 20 years from recording and auto-renews for 10-year periods. Amendments require 100% unit owner approval (except certain declarant rights during the period of declarant control).
