Legend Arroyo Condominium is a two-unit condominium community in Fountain Hills, AZ. You own your individual unit (A or B) and share ownership of common elements equally with the other unit owner. The association maintains common areas, and each owner is responsible for their unit and allocated limited common elements (e.g., yard, patio).
- Unit ownership & common elements: Each unit's boundaries are the exterior walls, slab bottom, and roof surface. Interior spaces and fixtures are limited common elements allocated to that unit. Yards and patios shown on the plat are also limited common elements for exclusive use. The undivided interest in common elements, votes, and common expense liability are split 50/50 between the two units.
- Use restrictions: Units may only be used as single-family residences. No gainful occupation, trade, or business is allowed (though personal professional library or phone calls are okay). Solar panels, satellite dishes, antennas, and clotheslines are prohibited if visible from neighboring property without adjacent owner's written consent. No vehicle repairs, inoperable vehicles, or nuisances are permitted.
- Alterations & improvements: Nonstructural interior changes do not require approval. Any structural alterations, changes to exterior color or texture, or modifications to exterior parts of the unit need prior written approval from the owner of the adjacent unit. The unit owner is responsible for any resulting damage to the other unit or common elements.
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance on their unit at full replacement value. Liability coverage must be at least $500,000 jointly with the adjacent unit owner. Proof of insurance must be provided to the adjacent owner.
- Assessments & voting: Common expenses are assessed equally per unit. Each unit has one vote in the association. The board consists of two members (both unit owners) after declarant control ends. Amendments to the declaration require unanimous consent of all unit owners.
- Architectural review: The condominium is subject to the Fountain Hills Committee of Architecture and an internal Architectural Committee appointed by the board. These committees regulate external design, appearance, and maintenance. In case of conflicting rules, the most restrictive applies.
- Dispute resolution: Disputes between unit owners must first be resolved through a 21-day written notice to the other owner. If not settled, the matter goes to binding arbitration selected by mutual agreement or by a Maricopa County Superior Court judge.
- Declarant's rights: During the period of declarant control (until 90 days after both units are sold to non-declarant owners), the developer may appoint and remove board members, maintain sales offices and signs, and amend the declaration to comply with laws or fix errors without owner consent.
