This declaration emphasizes neighbor coordination, as many decisions require consent of the adjacent unit owner. The association is responsible for common areas, but each owner maintains their unit and limited common elements (e.g., patios).
- What you own & maintain: Each unit (A or B) includes interior spaces and certain limited common elements like patios and exterior doors. Unit owners must maintain their unit and limited common elements. The association maintains the common elements, but if the association fails, owners may need to maintain the common areas adjacent to their unit.
- Use restrictions: Units may only be used as a single-family residence (defined as a group of related or unrelated persons maintaining a common household). No businesses, nuisances, outdoor clotheslines, or activities that breed pests are allowed. Solar panels, satellite dishes, and other external devices require advance written consent of the adjacent unit owner.
- Architectural & exterior changes: Nonstructural interior alterations do not require approval. Any structural change or modification to the exterior (color, texture) needs prior written approval from the adjacent unit owner. The architectural committee may also regulate external design.
- Parking & vehicles: No inoperable vehicles may be stored or parked visibly. Vehicle repairs visible from neighboring property are prohibited except for emergency repairs.
- Insurance: Each unit owner must maintain fire and liability insurance on their unit for at least $500,000 combined coverage (shared with adjacent owner if needed). Proof of insurance must be provided to the adjacent owner.
- Dispute resolution: Disputes between unit owners must first be resolved through a 21-day negotiation period. If unresolved, the matter goes to binding arbitration (either agreed arbitrators or American Arbitration Association). The prevailing party recovers fees and costs.
- Duration & amendments: The declaration runs for an initial 20-year term (from 2005) and automatically renews every 10 years. Amendments require unanimous vote of all unit owners (both units), unless the declarant exercises special rights during the declarant control period.
