What Vistoso at Mountainside Condominiums's governing documents say
Vistoso At Mountainside Condominiums is a condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains and insures. The declaration covers 4 initial units with potential expansion up to 48 units. This document is the full condominium declaration setting out use restrictions, assessments, and association powers.
- Use restrictions: Units and limited common elements must be used only for single-family residential purposes. No gainful occupation or business is allowed, but personal professional activities (e.g., keeping a library, handling calls) are permitted.
- Pets: Only one household pet per unit, not exceeding 20 pounds, allowed. Pets are permitted only for unit owners (not lessees). Dogs must be leashed (max 6 feet) when outside the unit, and owners must immediately remove droppings. No pet structures visible from outside.
- Leasing & rentals: Leases must be in writing, cover the entire unit, and be subject to the condominium documents. The owner must notify the association of lease start/end dates and occupant names. Leasing through a management company is allowed; otherwise, notice is required.
- Parking & vehicles: Parking is allowed only in designated spaces; temporary parking for guests, deliveries, and loading/unloading is permitted. Commercial vehicles, buses, vans, and trucks over 3/4 ton capacity are prohibited without board approval. Inoperable vehicles and non-temporary parking violations may result in towing at owner's expense.
- Architectural review: An Architectural Committee appointed by the Board must approve any structural additions, alterations, or improvements within a unit, as well as any change visible from the exterior (e.g., window coverings, exterior lighting, satellite dishes). Nonstructural interior changes that are not visible from outside do not require approval.
- Assessments & fees: The association adopts an annual budget and levies common expense assessments equally per unit (25% each initially). The maximum annual assessment starts at $100 per unit and can increase by CPI without a vote; larger increases require a 2/3 vote of members. Special assessments for capital improvements also require 2/3 approval. Delinquent assessments accrue 12% interest and a $10 late fee, secured by a lien on the unit.
- Maintenance responsibilities: The association maintains all common elements (including structural parts of limited common elements). Unit owners maintain their units and the non-structural parts of their limited common elements (e.g., patios, balconies). Owners are liable for damage to common elements caused by their negligence.
