Mimosa Crest is a condominium community in Fountain Hills, AZ, where you own your individual unit and share ownership of the building and grounds through the homeowners association. The association maintains the shared structure and common areas, funded by per-unit assessments; you maintain your unit's interior and any limited common elements (patio, garage, balcony) allocated to you.
- What you own & maintain: You own your unit's interior (from the unfinished inner surfaces of perimeter walls, floors, and ceilings); all exterior surfaces and the building structure belong to the association. You're responsible for maintaining patios, balconies, and garages allocated to your unit; the association maintains structural parts of those elements.
- Leasing & rentals: Leases must run at least 30 days minimum—no short-term or vacation rentals allowed. All leases must be in writing and comply with the governing documents; you must notify the association of lease start/end dates and tenant names.
- Pets: Maximum two domestic pets per unit (dogs, cats, or birds). Pets cannot exceed 18 inches in height at the shoulder. Dogs must be on a leash no longer than 6 feet when outside the unit and under your direct control at all times; you're responsible for cleaning up immediately after pets on common areas.
- Residential use only: Units are exclusively for single-family residential use; no commercial, gainful occupation, or professional business is permitted. You may maintain a personal professional library and handle personal business calls or correspondence from your unit.
- Architectural review: Architectural Committee approval is required for structural changes, exterior alterations visible from the building, antennas/satellite dishes, utility lines, window coverings, signs (limited to 9×30 inches for name and address), trash containers, and any modifications to limited common elements allocated to your unit.
- Vehicles & parking: No trucks, trailers, campers, boats, or recreational vehicles permitted, except trucks with camper shells or mini-vans under 205 inches in height and 80 inches in width used for regular transportation. No vehicles may be parked on streets within the condominium, and no vehicle construction, repair, or inoperable vehicles visible from neighboring property. The board may tow violations at owner's expense.
- Assessments: Common expense assessments are levied equally per unit to cover maintenance, insurance, and operations. The board adopts a budget at least 60 days before each fiscal year and can increase assessments during the year if funds become inadequate.
- Voting & membership: Each unit owner is an association member with one vote per unit. The association can suspend your voting rights if assessments remain unpaid or for up to 60 days following other violations of the governing documents.
