Mountainside Condominiums is a 2-unit condominium in Fountain Hills, AZ — you own your individual unit (A or B) and share the common elements equally with the other unit owner. This declaration governs how the units and common areas may be used, maintained, and altered. Both unit owners have equal votes and equal shares of common expenses.
- Single-family residential use: Each unit and its limited common elements must be used only as a single-family residence. No business or nonresidential activity is allowed, though you may keep a personal professional library or handle business calls from your unit.
- Exterior alterations & architectural review: No structural additions, exterior color changes, or modifications can be made without written approval from the owner of the adjoining unit. The declaration also establishes an Architectural Committee (appointed by the Board) to regulate external design, and the community is subject to the Fountain Hills Committee of Architecture — the more restrictive rules apply. Solar collectors, satellite dishes, and outside antennas are prohibited if visible from neighboring property without the adjoining owner's consent.
- Maintenance responsibilities: Each unit owner must maintain, repair, and replace their own unit and any limited common elements allocated to their unit (e.g., exterior doors, windows, balconies, patios). The association is responsible for maintaining the common elements. If one owner fails to maintain common elements, the other owner may step in.
- Insurance requirements: Each unit owner must carry fire, casualty, and liability insurance on their unit at full replacement value. Liability coverage must be at least $500,000 jointly with the adjoining unit owner. Proof of insurance must be provided to the other owner.
- Restrictions on personal property & activities: No garbage or trash may be kept except in approved covered containers. No outside clotheslines, inoperable vehicles, or major vehicle repairs visible from neighboring property are allowed. No nuisance or offensive activity is permitted.
- Dispute resolution: Disputes between unit owners must first be handled by written notice and a 21-day cure period. If not resolved, the matter goes to binding arbitration (by a mutually agreed arbitrator, or one selected by the Maricopa County Superior Court). The arbitrator's decision must be complied with within 30 days.
