Mimosa View Condominiums is a small condominium community in Fountain Hills, AZ — there are only two units (A and B), each with an equal 50% interest in the common elements. You own your unit's interior and certain limited common elements (like your patio, backyard, garage, and balcony), while the association maintains the building exteriors, landscaping, parking areas, and other shared spaces. - What you own & maintain: You own the interior of your unit (finished surfaces of walls, floors, ceilings) and are responsible for maintenance and repair of its interior, as well as limited common elements allocated to your unit: patio/balcony areas, backyard, garage (including door and opener), windows, doors, and the air conditioning/heater/water heater serving your unit. The association maintains the structural portions of the building, exterior paint (except garage doors, which you must periodically paint to match), common areas, landscaping, and irrigation.
- Assessments & fees: Annual assessments are set by the board and allocated equally between the two units (50% each). Special assessments require approval by more than 50% of unit owner votes. Assessments are due in installments (monthly to semiannually, as set by the board). Late payments accrue 10% annual interest plus late fees and collection costs. The association has a lien on your unit for unpaid assessments.
- Use restrictions (vehicles, storage, nuisances): No boats, RVs, trailers, or vehicles not in daily use may be stored in the driveway for more than 72 hours in a 30-day period. Common elements and limited common elements (except patios/balconies/backyards) may not be used for storage. Exterior furniture not in current use, storage units, and vehicle parts are not allowed in visible areas. No clotheslines, exterior speakers (except security), or nuisances are permitted. Fires are limited to contained barbecue or fire pit receptacles in limited common areas.
- Insurance: The association maintains a master property insurance policy on the common elements (at least 80% replacement cost) and liability insurance covering common areas. Each unit owner may purchase their own policy for their unit, personal property, and personal liability. The association's policy is primary and does not cover your personal belongings or additions.
- Maintenance & repair obligations: Owners must keep their unit and allocated limited common elements clean and in good repair. If an owner fails to maintain after 30 days' written notice, the association may perform the work and charge the owner (as a special assessment secured by lien). Owners are liable for damage to common elements caused by themselves, their occupants, or guests.
- Dispute resolution: Any dispute arising from the declaration must first go to mediation in Maricopa County, AZ, and if unresolved, then to mandatory binding arbitration under the Arizona Revised Uniform Arbitration Act. The parties share joint costs and pay their own legal fees unless the arbitrator orders the losing party to pay the winner's reasonable out-of-pocket costs.
