Via Linda Condominiums is a two-unit condominium in Fountain Hills, AZ. You own your individual unit and share ownership of common elements with the other owner. This document is the full rulebook for the community, binding all unit owners.
- What you own & maintain: Each unit (A and B) includes interior spaces; boundaries are the exterior surfaces of walls, floors, and roof. Limited common elements allocated exclusively to each unit include covered patio, backyard, and any meters serving only that unit. You may not paint or alter exterior surfaces without board approval.
- Use restrictions: No dumping, storage of furniture or vehicles not in current use, or clotheslines allowed in common or limited common elements. Exterior fires only in approved barbecue receptacles on limited common elements. No nuisance or offensive activities.
- Assessments & fees: Annual and special assessments are split equally between the two units (50% each). Special assessments require 100% owner approval. Late payments accrue 10% annual interest plus reasonable late fees. The association can place a lien and foreclose for unpaid assessments.
- Insurance: The association maintains property insurance on common elements (at least 80% replacement cost) and liability coverage. Each owner is an insured for liability arising from common element ownership. Owners should obtain their own coverage for their unit and personal property.
- Maintenance responsibilities: The association maintains all common elements. Each owner must maintain their unit and limited common elements (patio, doors, windows, HVAC, roof above their unit). If an owner fails to maintain after 30 days' notice, the association may do the work and charge the owner.
- Parking & vehicles: Routine overnight parking of daily-use vehicles is permitted. Boats, RVs, trailers, or vehicles not in daily use may not be stored in driveways for more than 72 hours in any 30-day period.
- Dispute resolution: Any dispute under the declaration must first go to mediation in Maricopa County, Arizona, then to binding arbitration by a three-arbitrator panel. Each party pays its own costs and attorneys' fees unless the arbitrator decides otherwise.
