Sunset View Condominiums is a condominium community in Fountain Hills, AZ. These bylaws govern the homeowners association and apply to all present and future owners, tenants, and anyone using the property.
- Voting & meetings: Each unit gets one vote (if co-owned, one owner designated). A majority of owners means >50% of votes. Quorum is 20% of total votes. Meetings require at least 5 but not more than 20 days' notice. Special meetings can be called by the Board or by petition of a majority of owners.
- Board of Directors: The Board is composed of 3 directors, all must be unit owners or their authorized representatives. Directors serve staggered 3-year terms. They can be removed with or without cause by a majority of owners. The Board manages the association, including maintenance of common elements, budget, assessment collection, insurance, and rule enforcement.
- Assessments & budget: All owners must pay monthly assessments determined by the Board, based on each unit's percentage interest in common elements. Assessments cover insurance, maintenance, utilities on common elements, reserves, and recreational facilities. The Board must prepare an annual budget and notify owners of charges. Late penalties may apply.
- Insurance: The Board must obtain and maintain fire, hazard, and liability insurance covering the entire property (not just common elements), in an amount equal to replacement cost.
- Books & records: The association must maintain complete books of account, open to inspection by any owner upon written demand for a purpose related to their interest. Owners holding 40% of votes can demand an independent audit at association expense, provided the request is made at least 60 days before the annual meeting.
- Amendments: These bylaws may be amended by a majority vote of the Board of Directors at any meeting where notice of the proposed amendment is included, provided no amendment conflicts with the Declaration of Condominium Regime.
- Rules & regulations: The Board shall adopt rules and regulations for managing the property, which apply to owners, lessees, tenants, and guests.
