Palm Tree Villas is a condominium community in Fountain Hills, AZ — you own your individual unit and share ownership of the common elements (building structure, common areas). The association maintains common elements, carries master insurance, and enforces the rules. All unit owners are automatically members of the homeowners' association and share equally in common expenses.
- Single-family residential use: Units and limited common elements may only be used as a residence by a single family. A 'single family' includes groups related by blood, marriage, or adoption, or a group of unrelated persons sharing a common household. No business, profession, or trade is allowed on the premises (except personal professional library or handling personal business calls/records).
- Leasing & rentals: Leases must be for the entire unit (no partial leasing) and for a term of at least 30 days. All leases must be in writing and must include a provision that the lease is subject to the condominium documents. The unit owner must notify the association of the lease start and end dates and names of occupants.
- Pets: No more than two house pets (dog, cat, or bird) per unit. No pet may exceed 18 inches in height at the shoulder (standing). All dogs must be leashed (max 6 feet) when outside the unit or allocated limited common element. Pet droppings must be immediately removed. No outdoor pet structures visible from outside the building.
- Antennas & satellite dishes: No outdoor antennas, satellite TV dishes, or other transmission/reception devices may be erected without prior written approval from the Architectural Committee. All utility lines (including telephone, TV, radio) must be installed underground or concealed, unless approved.
- Parking & vehicles: Trucks, trailers, campers, boats, and recreational vehicles may not be parked or stored on the condominium property, except for trucks with camper shells and mini-vans not exceeding 205 inches in height and 80 inches in width used for basic transportation. No inoperable vehicles visible from neighboring property. No parking on streets within the condominium. The board may tow violating vehicles at owner's expense.
- Architectural review: No structural additions, alterations, or improvements may be made inside or outside a unit without prior written approval from the Architectural Committee. Any exterior change (including window coverings, signs, or anything visible from outside) also requires committee approval. The committee may require an engineer's certification for structural work.
- Assessments: Common expense assessments are allocated equally among all units (each unit's share is 8.33% — based on 12 units — but may be reallocated if units are added). The board adopts an annual budget and sets the assessment. Special assessments require approval by two-thirds of unit votes. Assessments are personal obligations of the current owner.
