What Saguaro/Sterling Condominiums's governing documents say
Saguaro/Sterling Condominiums is a 2-unit condominium community in Fountain Hills, AZ. You own your individual unit and share equal ownership (50%) of the common elements with the other unit owner. The homeowners association manages common areas, enforces rules, and collects assessments. This is a full set of governing documents (Declaration, Bylaws, Articles).
- What you own & maintain: You own the interior of your unit; the exterior surfaces, roof, slab, and common elements are shared. Limited common elements (e.g., patios, balconies, certain utility lines) are allocated to your unit for exclusive use but you must maintain them. The association maintains common elements.
- Use restrictions: Units must be used exclusively as a single-family residence. No gainful occupation, business, or trade allowed (except personal professional use like a home office). No nuisances, outside clotheslines, inoperable vehicles visible from neighboring property, or solar/satellite devices without adjacent unit owner consent.
- Architectural review: Any structural changes, exterior color/texture modifications, or improvements visible from neighboring property require prior written approval from the adjacent unit owner. The Association's Architectural Committee (appointed by the Board) also enforces design rules. Additionally, the community falls under the jurisdiction of the Fountain Hills Committee of Architecture; the most restrictive rule applies.
- Assessments & fees: Common expenses are assessed equally (50% per unit). The Board sets a budget and may levy monthly assessments. Delinquent assessments accrue late penalties, and the Association can file liens. Assessment liens are subordinate to first mortgages.
- Dispute resolution: Disputes between unit owners must first go through a 21-day negotiation period. If unresolved, the matter is submitted to binding arbitration (by an arbitrator or board selected by agreement or by the Maricopa County Superior Court).
- Insurance: Each unit owner must maintain fire, casualty, and liability insurance with at least $500,000 combined liability coverage (jointly with the adjacent owner). Proof of insurance must be provided to the adjacent unit owner.
- Leasing & rentals: No specific lease term minimum is stated in the document; however, units must be occupied by a single family and used only for residential purposes. Leases are subject to all governing documents, and owners are responsible for their tenants' compliance.
- Amendments & duration: The Declaration runs for 20 years from recording (2000), automatically renewing for 10-year periods. Amendments require unanimous unit owner consent (100% vote) except during the Declarant Control Period or as allowed by the Arizona Condominium Act.
