What Bella Verde's governing documents say
Bella Verde is a single-family residential planned community in Gilbert, Arizona. Owners are bound by deed restrictions enforced through the Bella Verde Homeowners Association, which maintains common areas and collects per-lot assessments. The community requires strict architectural review and desert-compatible landscaping standards for all visible improvements.
- Architectural Review & Approval Process: All visible improvements—excavation, structures, landscaping, exterior colors, and alterations—require prior written approval from the Architectural Review Committee. The committee has 45 days to approve or deny; failure to act is deemed disapproval. Owners must complete approved work within one year. The committee may charge a review fee and require a compliance bond to ensure completion and cleanup.
- Design Standards: Improvements must meet minimum desert-compatibility standards: earth-tone colors, new construction only (no moved structures), and plants exclusively from the Arizona Department of Water Resources Low Water Use/Drought Tolerant Plant List for the Phoenix Active Management Area.
- Temporary Structures & Occupancy: No trailers, tents, shacks, basements of incomplete buildings, or temporary structures may be used as residences, temporary or permanent. Temporary construction equipment and trailers require approval and must be removed immediately after construction completion, never kept longer than 12 months.
- Nuisances & Construction Conduct: No animal waste, rubbish, or debris may accumulate on lots or common areas; no odors, dust, smoke, glare, or loud noise is permitted. During construction, materials and equipment must be stored only in approved areas, lots must remain neat and tidy, and debris must not accumulate.
- Wildlife & Environmental Risks: The property is in a desert area where javelinas, coyotes, mountain lions, scorpions, snakes, and other native wildlife may enter lots and cause damage, injury, or death. Nearby properties allow horses and livestock, which may create noise, odors, and danger. Owners assume all risk and release the Association and developer from liability for any wildlife-related claims.
- Views & Natural Light: No guaranteed views or rights to light and air exist. Views may be impaired or blocked by future construction, landscaping, or natural plant growth within or outside the community, whether by the developer, other owners, or third parties.
- Assessments & Liens: Annual assessments are levied per lot to fund the Association's maintenance and operations. Special and benefited assessments can also be imposed. Non-payment of assessments creates a lien on the property.
- What this document excerpt does not cover: This excerpt includes the beginning of the governing document. Full rules on pets, vehicles, leasing, utilities, parking, mechanical equipment, and other use restrictions are referenced in the table of contents but the actual text is not provided in this excerpt.
