This 2009 amendment to the 1974 declaration clarifies that unit owners are responsible for maintaining their roofs and rooftop utilities, while the association maintains shared structural elements. Special assessments for capital improvements require two-thirds owner approval.
- Your roof & utilities — your responsibility: You must maintain your unit's roof and all rooftop equipment (HVAC, gas/cable/water/electric lines and meters, pipes, ducts, conduits) in good condition. If you don't repair within 15 days of written notice from the association, they may do the work and bill you as a Common Expense.
- Shared structural elements — association maintains: The association maintains loading docks, truck wells, well drains, and interior walls separating units. If you damage one, you pay the full repair cost; if damage comes from other causes (including wear and tear), affected neighbors split the cost equally.
