What Rome Towers Condominium's governing documents say
Rome Towers Condominium is a commercial condominium in Gilbert, AZ — you own a unit within a five-story building, but units cannot be used as residences. Upper-floor units are limited to commercial offices and professional services (e.g., medical, legal, accounting). First-floor units may also be used for retail uses permitted by zoning, without a special permit. The declaration binds all unit owners, tenants, and occupants.
- Use & occupancy restrictions: Units above the first floor may only be used as commercial offices or professional services offices (e.g., law, medical, accounting) permitted without a special use permit. First-floor units may also be used for retail. No residential use is allowed.
- Animals: No animals, birds, reptiles, or livestock are permitted except fish in aquariums and service animals for persons with disabilities.
- Parking & vehicles: Only Authorized Vehicles (passenger cars, SUVs, vans ≤10 passengers, motorcycles, pickup trucks ≤1 ton, all ≤7 ft tall) may be parked in designated parking spaces. Parking spaces are limited common elements allocated to specific units. No maintenance, repair, or storage of vehicles in the parking garage. Vehicles may be towed at owner's expense if violating rules.
- Signs & window coverings: No exterior signs (including 'for sale' or 'for rent' signs) are allowed without prior written board approval. Approved signs must comply with town ordinances. Window coverings that affect exterior appearance (e.g., reflective materials, drapes, blinds) require board approval; the board may establish a uniform standard.
- Leasing & rentals: Leases must be in writing and state that they are subject to the declaration and rules. At least 10 days before lease commencement, the owner must provide the association with lease dates, lessee names, owner contact info, emergency contact, and the unit's 'use' (as permitted by this declaration). The owner is liable for any violations by tenants or their guests.
- Maintenance responsibilities: The association maintains and repairs all common elements (including perimeter building walls but excluding windows within units). Unit owners are responsible for all interior improvements (partitions, drywall, floor coverings, lighting, utilities) and must construct them according to adopted tenant improvement standards. Owners must also maintain their limited common elements (e.g., balconies, allocated parking spaces).
- Alterations & improvements: Any structural additions, alterations to perimeter walls or party walls, or changes visible from the exterior require prior board approval. Nonstructural interior changes do not need approval but must not damage other units or common elements. The board may impose conditions such as security deposits, insurance, and use of licensed contractors.
