La Vida Serena Square is a single-family home subdivision in Gilbert, AZ. This declaration of covenants, conditions, and restrictions (CCRs) applies to all lot owners and is designed to protect property values and uniformity. - Architectural approval: No building, fence, or other structure may be started or erected until plans and specifications (including shape, height, materials, and location) are approved by an officer of Los Arcos Development Corporation (until 75% of lots sold) and then by a committee elected by a majority of lot owners.
- Utility lines and undergrounding: All public utility lines and wires must be brought from the lot line underground, not overhead, unless permission is granted by the designated approving authority.
- Easements: A blanket easement exists for ingress, egress, and installation/maintenance of utilities (water, sewer, gas, telephone, electricity, and master TV antenna). Utility companies may erect poles, but no utilities may be installed or relocated without approval from the developer or the association's board.
- Enforcement: Violations may be restrained by court order, and damages may be awarded. Mandatory injunctions can require removal of structures or trailers. Violators pay all legal costs. These restrictions do not affect existing mortgage liens.
- Duration and amendment: These restrictions run with the land and are binding until July 1, 2002, after which they automatically extend for successive ten-year periods unless a majority of lot owners vote to change them.
