These supplemental declarations establish design, construction, and assessment rules for Parcels 19 and 12, binding individual lot owners. The documents cover architectural approval, landscaping, infrastructure standards, and shared costs—but refer to the master Seville HOA Declaration for general governance.
- Minimum size & construction standards: Single-family residences, new construction only. Parcel 19: minimum 3,000 sq ft (one-story) or 2,600 sq ft (two-story, upper level max 40% of above-ground area); Parcel 12 Custom Homes: minimum 3,000 sq ft, one-story only. Both require 75 ft minimum lot width. All roofs must be tile (clay or concrete), except flat roofs concealed by a parapet with approved design.
- Architectural review & approval process: Design Review Committee approval required before construction begins on any residence, garage, fence, or landscaping—including footings and grading plans. $500 fine (becomes a lien) for unauthorized construction. Committee has 60 days to act; if no response, approval is deemed granted (unless the design violates specific restrictions).
- Lot layout & utilities: Maximum lot coverage 30%. Parcel 19 setbacks: Front 40 ft, Side 20 ft, Rear 40 ft. Parcel 12 setbacks: Front 30 ft (side-entry garage) or 40 ft (garage face), Side 20 ft, Rear 40 ft. All electric, gas, water, sewer, and telephone lines must be underground. No trailers, mobile homes, RVs, or temporary structures allowed as residences.
- Landscaping requirements & escalating fines: Parcel 19: plant minimum 2 thirty-six-inch box trees in front yard within 90 days of occupancy. Parcel 12: plant minimum 3 thirty-six-inch box citrus trees approximately 10 feet from street curb within 6 months of occupancy. Noncompliance fines start at $25/week (day 15), rise to $50/week (day 30) and $100/week (day 60), then double every 30 days thereafter. Landscape plan must be approved by Design Review Committee first.
- Shared fences & walls: Owners must build and maintain 6-foot block walls on side and rear boundaries (varies by lot position). Neighbors sharing a boundary split construction and maintenance costs 50/50, with 30-day reimbursement deadline. Unpaid shares become liens on the lot and are enforced like other association liens.
- Required gas appliances: Owners must install natural gas lines and maintain a gas water heater, a gas space heater, AND one of: gas dryer, gas fireplace, or gas range top. All gas installations must be shown in approved architectural plans.
- Neighborhood assessments & weed control fees: Neighborhood assessments fund private streets, streetlights, curbs, sidewalks, and (on Parcel 12) entry gates; amount set by the Board. Quarterly upkeep assessment for contractor weed control: minimum $75/quarter, due in advance. All unpaid assessments become liens on the lot.
