What The Offices at Seville Condominium Association's governing documents say
The Offices at Seville is a commercial condominium association in Gilbert, AZ — you own an office unit within a six-building professional campus, and the association maintains the shared common areas. This document is the full set of covenants, conditions, and restrictions that govern use, maintenance, assessments, and rules for all owners and tenants.
- Permitted use: Units may only be used for healthcare, professional offices (medical, dental, chiropractic, etc.) and related ancillary uses. No residential or housing use is allowed.
- Leasing & rentals: All leases must be in writing, include a clause binding the tenant to the governing documents, and a copy must be delivered to the board before the lease begins. No minimum lease term is stated, but overnight parking is prohibited, effectively limiting residential-style occupancy.
- Parking & vehicles: Parking spaces are part of the common elements. Reserved/covered spaces are allocated by the board (initially one per 1,000 sq ft of unit area); unassigned spaces are first-come, first-served. Overnight parking is not permitted.
- Animals: No animals, reptiles, fish (except aquariums inside a unit) or birds may be kept in any unit or on common elements without prior written board approval.
- Architectural review & exterior changes: Exterior changes, additions, painting, signs, landscaping, awnings, window tinting, and structural changes require board or architectural control committee approval. Plans must be submitted and approved (or deemed approved after 30 days). Signs must also comply with city codes.
- Assessments & common expenses: The association levies annual, special, and supplemental assessments based on each unit's allocated interest in common elements. Assessments are a lien on the unit and a personal obligation of the owner at the time levied. Special assessments require approval by a majority of members (more than 85% of votes).
- Maintenance responsibilities: The association maintains common elements (including exteriors, parking, landscaping, utilities, etc.). Each owner is responsible for maintaining their unit's interior and HVAC equipment, including installation, maintenance, and replacement at their own expense.
- Environmental & hazardous substances: Owners and occupants must comply with all environmental laws. Hazardous substances are only allowed in de minimis quantities necessary for business use, and must be stored and handled in compliance. The owner must notify the board of any releases, claims, or orders related to hazardous substances.
