What Cactus Flats's governing documents say
Cactus Flats is a 102-unit condominium community in Glendale, AZ, converted from apartments (built 1985). This Declaration binds all unit owners, lessees, and occupants. Units are for residential use only; each owner gets one vote and an equal 1/102 share of common expenses.
- Use restrictions: Units must be used exclusively as residences. No trade or business is allowed, but home-based businesses are permitted if they are not detectable outside the unit, involve no customer visits, and comply with zoning. Leasing a unit is not considered a business.
- Leasing & rentals: Leases must be in writing, for a term of at least one month, and must acknowledge the governing documents. Subleasing and assignment of leases are prohibited. The owner must provide a copy of the lease and tenant contact info to the association at least 10 days before commencement. The owner is liable for tenant violations.
- Pets: Permitted pets are dogs, cats, fish, or small birds commonly kept as household pets. No more than two total dogs or cats (or a combination), and no dog over 25 pounds. Pets must be leashed on common elements, cannot be left on patios/balconies, and owners must clean up waste. The board may ban specific breeds deemed dangerous.
- Parking & vehicles: Only authorized vehicles (cars, SUVs, passenger vans ≤10 people, motorcycles, light pickup trucks ≤7 ft height) may be parked in designated parking spaces. No vehicle maintenance, repair, or storage on common elements. Spaces may be leased only to other owners, lessees, or occupants. The board may tow violators at owner expense.
- Architectural alterations: No additions, alterations, or improvements to a unit or common elements without prior written board approval. Exceptions: interior paint, wallpaper, and carpeting. Visible alterations require board approval for aesthetic harmony. The board may require engineering certification, insurance, and a security deposit. All work must be by licensed contractors.
- Noise & sound reduction: Units on the second floor may not have hard floor coverings except in kitchens and bathrooms. Any hard flooring must use a sound-control underlayment. The board may adopt noise rules. No loudspeakers affixed to walls or ceilings that cause discernable vibrations between units.
- Patios & balconies: Furniture, plants, and decorations must be neutral-colored and not extend above the railing. No astroturf, carpet, spas, or hot tubs. No storage of bicycles or exercise equipment. Items may not be hung from railings or walls. Board approval required for any changes to flooring or landscaping.
