It binds the property owner (Homeward Bound) to federal HOME Program rules for 15 years — limiting rents, restricting tenants to low-income households, and protecting tenant rights. Residents are renters who benefit from these restrictions; this is not a typical HOA or condo rulebook.
- Affordability & rent limits: At least 20% of HOME-assisted units must rent to very low-income families (≤50% of area median income) at rents no more than 30% of that income. The remaining units must rent at the lesser of HUD fair market rent or 30% of 60% of area median income. Rents must subtract a utility allowance for tenant-paid utilities. Rents are reviewed and approved annually by the Arizona Department of Commerce.

The lease cannot include certain prohibited terms, such as waiving the tenant's right to sue, admitting guilt, allowing the owner to evict without court proceedings, or requiring the tenant to pay attorney fees if the tenant wins a lawsuit. Owners must use written tenant selection policies that are fair and maintain a waiting list.
- Period of affordability: The affordability restrictions run for 15 years from project completion. The covenant runs with the land and binds all future owners. After foreclosure, the period may be suspended but revives if the original owner regains ownership.
- Property maintenance: The owner must maintain the property in accordance with HUD housing quality standards (24 CFR 882.109) and all applicable local codes and zoning ordinances.
- Affirmative marketing: The owner must adopt affirmative marketing procedures, including using equal housing opportunity logos, advertising in minority-owned media, and reaching out to groups least likely to apply. Records of marketing efforts must be kept and made available for inspection.
