What Cactus Glenn's governing documents say
Cactus Glenn is a single-family residential homeowners association in Glendale, Arizona, where you own your lot individually and automatically become an association member. You are subject to annual assessments, architectural approval for any exterior changes, single-family use restrictions, and enforcement through fines and suspension of rights.
- What you own & what the association owns: You own your lot in fee simple. The association owns and maintains all common areas (including retention basins, drywells, and landscaping) and certain public rights-of-way that the city requires the association to maintain.
- Membership & voting: Every lot owner automatically becomes a voting member with one vote per lot. Tenants do not have voting rights. The developer currently holds 9 votes per lot (converting to 1 vote per lot when all developer-owned lots are sold).
- Assessments & late-payment costs: Owners must pay annual assessments for common area operations; the association can also levy special assessments for capital improvements. Payments more than 15 days late incur interest at up to 12% per year plus a late fee of whichever is greater: $15 or 10% of the unpaid amount.
- Insurance the association maintains: The association carries property insurance at 100% replacement cost, public liability insurance ($1 million per occurrence, $2 million aggregate), directors' and officers' liability insurance ($1 million per claim, $2 million per year), and fidelity bonds for association funds.
- Architectural review for changes: You must obtain Architectural Review Committee approval before making any exterior modification to your lot, including alterations, additions, landscaping changes, color changes, or structures. The developer is exempt during the development period.
- Use restrictions & enforcement: Lots must be used for single-family residential purposes only. The association enforces rules through written violation notices with a published fine schedule and board hearings. The board can suspend your common area use rights and voting rights until violations are cured and can perform corrective work at your expense if you don't cure within the specified time period.
