This declaration of covenants, conditions, and restrictions (CC&Rs) applies to all lot owners and outlines what living here requires of you. It covers allowed uses, construction standards, pet limits, vehicle storage, fencing, landscaping, and HOA assessments.
- Land use & construction: Lots are for residential single-family use only; no business or commercial activity allowed. All dwellings must be new construction (no moved buildings). Minimum livable area is 2,500 square feet, excluding garages and porches. Construction must start within 13 months and 29 days of closing and be completed within 13 months and 29 days of start.
- Exterior design & materials: Exterior surfaces must be brick, colored block, or frame stucco. Roofs must be mission tile, clay tile, concrete tile, or similar quality approved by the developer or HOA. No flat roofs. Prefabricated or pre-constructed buildings require Architectural Committee approval. Garages must be fully enclosed with doors; no open carports allowed. Solar collectors must be screened from view.
- Pets & animals: Only domestic dogs, cats, fish, and caged birds are allowed—no livestock, poultry, or other animals. No more than two each of dogs, cats, and birds per unit. Pets must be leashed when outside the home. Owners are responsible for cleanup; $10 assessment for unsanitary conditions on common property. The Board can determine if an animal is a nuisance and prohibit it.
- Vehicles & parking: No mobile homes, trailers, boats, recreational vehicles, commercial vehicles, truck campers, or motorcycles may be kept on common areas or streets. Vehicles visible from the street or neighboring units may not be constructed, repaired, or dismantled on lots, except emergency repairs. Guest parking is not addressed in this document.
- Fencing & landscaping: Six-foot block fencing is mandatory on rear lot lines and side lot lines to at least the rear corner of the home; cost sharing between adjacent owners is encouraged, but each owner maintains their own fence. Landscaping on front and side yards visible from the street must be complete within 6 months of final construction inspection.
- Assessments & common area maintenance: The HOA maintains common areas funded by monthly, semi-annual, or annual assessments paid by each lot owner. Delinquent assessments incur a penalty of $10 for the first 10 days and $2 per day thereafter, plus attorney fees. Owners cannot exempt themselves by not using common areas.
- Architectural review: The Architectural Committee (appointed by the Board) must approve all exterior changes, including construction, fencing, and driveways (paved with concrete, brick, or approved hard surface; no dirt, granite, blacktop, or asphalt). If the Committee does not act within 30 days, approval is deemed granted. The Board can override Committee decisions.
