Glendale Corporate Center is a commercial office business park (not residential). Owners of parcels within the park are bound by this declaration, which governs use, development, maintenance, and costs. Prospective buyers or ground lessees should expect restrictions on business types, approval requirements for construction and signs, and mandatory contributions to common area expenses.
- Permitted & prohibited uses: The business park is for lawful general office purposes only. Prohibited uses include: residential; hotels or sleeping quarters; hazardous materials; immoral uses (e.g., adult stores); outdoor storage (except during construction); and any use creating a nuisance. Additional restrictions may be added by the Declarant.
- Construction & exterior changes: No building, structure, or exterior alteration may be built or changed without Declarant's prior written approval. Plans and specifications must be submitted at least 30 days before construction. All work must comply with approved plans and applicable codes. Signs also require Declarant's approval and must follow the Signage Criteria.
- Common area & easements: All owners and their permittees have non-exclusive easements over the common area for parking, pedestrian/vehicular access, utilities, drainage, and temporary construction. The Declarant maintains the common area (landscaping, paving, lighting, etc.) and may establish rules for its use. Owners must also maintain their own separate utility lines.
- Maintenance responsibilities: Each owner must maintain their building and improvements in safe, clean condition. If an owner fails to maintain, Declarant may step in after notice and bill the owner. The Declarant maintains common areas and common utility lines. Exempt owners (designated by Declarant) maintain their own common areas instead of paying shared costs.
- Common area expenses & assessments: Obligated owners pay a proportionate share of common area maintenance expenses based on their building square footage relative to all buildings in the park. Payments are made in equal monthly installments based on Declarant's estimate, with annual true-up. Unpaid amounts bear interest at 18% per year (Default Rate) and can become a lien on the parcel.
- Signage & monument signs: Monument sign easements are granted for specific parcels (Parcel C, Parcel D, and a Business Park sign). The benefiting owner (e.g., Parcel A for Parcel C sign) must pay permit fees and maintain the sign. All signs must comply with Declarant's Signage Criteria and governmental rules.
- Enforcement & liens: If an owner fails to pay assessments or maintain their property, Declarant may record a lien (Notice of Assessment Lien) and foreclose. For maintenance defaults, Declarant may cure and bill the owner; nonpayment within 15 days triggers a lien. Declarant may also exclude non-permittees and close common areas to prevent prescriptive rights.
- Insurance: Declarant may, at its option, obtain fire, liability, and property damage insurance for the common area (excluding exempt owners' parcels). Exempt owners must insure their own common area improvements.
