What The Winds of Campbell Association's governing documents say
The Winds of Campbell is a standard single-family home subdivision (lots 1-102) governed by a Homeowners Association. This Declaration of Covenants, Conditions and Restrictions sets the rules for all owners, residents, and guests. It establishes the Association, architectural controls, and use restrictions to maintain property values.
- Property use & restrictions: All lots are limited to single-family residential use only. No business, trade, or non-residential activity is allowed. Only one single-family dwelling with up to a two-car garage may be built. No further subdivision or condo conversion is permitted without Board approval.
- Assessments & fees: Annual assessments started at $10/month per lot (until Jan 1988) and may increase annually based on the Consumer Price Index without a vote. Special assessments for capital improvements require a two-thirds vote of each membership class. Assessments are a personal obligation and a lien on the lot. Late payments accrue 12% interest.
- Architectural control: Any exterior improvement, alteration, painting, or excavation requires prior written approval from the Architectural Committee. The committee has 30 days to decide; after that, approval is deemed given. Fences, color schemes, and building materials are subject to approval. The committee may adopt rules to guide design.
- Vehicles & parking: No vehicle over 3/4 ton, mobile home, travel trailer, boat, or similar equipment may be parked visibly from neighboring property or common areas. Pickup trucks under 3/4 ton with camper shells under 7 feet and mini-motor homes under 7 feet tall and 18 feet long are exempt. Only operating vehicles may be parked in uncovered areas. Garages cannot be converted to living space.
- Pets & animals: Only a reasonable number of common house or yard pets are allowed, kept as domestic pets (not for commercial purposes). Pets must not create unreasonable noise or become a nuisance. Structures for pets must not be visible from neighboring property. The Board has discretion to decide what is reasonable.
- Leasing & rentals: Leasing of a lot is permitted, subject to all provisions of the Declaration and to any rules adopted by the Association. No minimum lease term is specified in this document. All tenant use is subject to the same restrictions as owners.
- Maintenance obligations: Owners must keep their lot and improvements in good repair and adequately painted. The Association maintains common areas. If an owner fails to maintain, the Association may do so after 30 days' notice and charge the owner (plus 12% interest). Lawns and plantings on common areas are maintained by the Association.
- Signs & antennas: No signs are allowed except a single name/address sign (max 9" x 30") and one temporary 'for sale' sign (max 5 sq ft). No outdoor antennas or satellite dishes may be erected without Board approval. Utility lines must be underground.
