You own your individual unit and share ownership of the building's common elements; the association maintains the shared structure and grounds, funded by per-unit assessments, and enforces strict architectural and use restrictions.
- What you own & maintain: You own the interior finished surfaces, floor, ceiling, and half-depth of interior party walls of your unit. The association owns and maintains all common elements (building structure, grounds, utilities). Each unit owner holds an equal share of common elements and receives one vote in the association.
- Use restrictions: Units are restricted to single-family residential use only—no businesses or gainful occupations, though you may maintain personal professional records or handle business calls at home. Solar panels, satellite dishes, antennas, outdoor clotheslines, and temporary structures (trailers, tents, shacks) are prohibited. Motor vehicles cannot be repaired or stored if visible from neighboring properties.
- Architectural review & approvals: Any structural changes require Architectural Committee approval plus certification from a licensed Arizona architect. Non-structural changes visible from outside also require approval from both the Committee and your adjoining unit's owner. All utility lines must be installed underground or concealed.
- Maintenance & repair responsibilities: Unit owners maintain their units and allocated limited common elements (yards, patios, exclusive portions) at their own expense. The association maintains all other common elements. If you fail to maintain within 30 days of written notice, the association can perform the work and charge you a special assessment for the cost.
- Assessments & fees: Common Expense Assessments are levied equally among all units. Assessments unpaid more than 15 days after due date accrue 12% annual interest (or the prevailing FHA/VA rate, whichever is higher) plus a $10 late charge. The association has a lien on your unit to enforce collection, subordinate to first mortgages.
- Insurance requirements: You must maintain fire, casualty, and liability insurance on your unit at full replacement value with a carrier rated B+ or better. Liability coverage must be at least $500,000 per unit (or joint with adjoining unit owner). You must provide proof to the association and adjoining owner.
- Utilities & easements: Easements allow utility companies and the association to access and maintain utilities (gas, water, sewer, electric, telephone, cable, communications) through common elements, including rights of ingress and egress for repair and installation work.
