Tierra Linda Oeste is a standard single-family home subdivision in Glendale, AZ, governed by a Homeowners Association (HOA). This Declaration of Covenants, Conditions, Restrictions and Easements (CC&Rs) establishes rules for all owners, residents, and guests. The HOA manages common areas and enforces the rules to protect property values.
- Land use & occupancy: Lots may only be used for single-family residential purposes. A 'Single Family' is defined as persons related by blood, marriage, or adoption, or a group of up to three unrelated persons living together as a household. No commercial or business activity is allowed unless it is not detectable from outside the home, conforms to zoning, and doesn't involve door-to-door solicitation.
- Pets & animals: No more than three generally recognized household pets may be kept on a lot at any time. Pets must be kept inside the dwelling, in a fenced yard, or on a leash. Owners must immediately remove droppings. Structures for pets (e.g., dog houses) cannot be visible from neighboring property without Board approval.
- Parking & vehicles: Parking or storing inoperable vehicles, boats, trailers, motor homes, or trucks with a payload capacity of three-quarter ton or more is prohibited if visible from neighboring property. Exceptions include sport utility vehicles, pickup trucks under 3/4 ton, and mini-motor homes under 7 feet tall and 18 feet long, provided they are regularly used for transportation. All vehicles must be parked in garages or designated areas approved by the Board.
- Architectural control: No exterior alterations, additions, fences, landscaping changes, or color scheme changes may be made without prior written approval from the Declarant (during developer control period) or the Board (afterward). The Board may adopt Architectural Guidelines. Even antennas and satellite dishes must be inconspicuous and approved.
- Maintenance obligations: Owners must maintain their lots, including buildings, landscaping, and paved areas, in good condition. Dead plants must be replaced. The Association maintains common areas (Tracts A and B) and other designated areas. If an owner fails to maintain their lot, the Board may step in and charge the owner, secured by an assessment lien.
- Assessments & fees: Annual assessments are levied on each lot to cover common expenses. The initial maximum annual assessment is $0.00 until the first lot is sold; thereafter it can be increased annually by up to 10% or the CPI increase, whichever is greater, without a membership vote. Special assessments require a 2/3 vote of members. Delinquent assessments incur 15% interest and late fees, and create a lien on the lot.
- Enforcement & penalties: The Association, Declarant, or any owner may enforce the rules through legal action or by remedying violations directly. The Board can levy fines for violations. For rule violations that remain uncured after 15 days' notice, the Board may suspend an owner's right to use common areas and their voting rights.
