This document is a supplemental declaration between developers that imposes use and building restrictions on specific parcels within the project. - Permitted uses: The Owner's Parcel may only be used for retail, service-retail, restaurants, and banks/credit unions/financial institutions.
- Building height: Buildings on the Owner's Parcel shall not exceed 26 feet in height measured from finished floor elevation (28 feet for parapets and other architectural features).
- No-build areas: View corridors for the Office Parcel must be preserved. No improvements other than typical parking lot improvements (paving, curbs, sidewalks, landscaping, lighting, signs) are allowed in the designated McDowell No-Build Area and Bullard No-Build Area.
- Plan approval: Before construction, the Parcel Owner must submit improvement plans to SunCor for approval. SunCor has 30 days to review; if not disapproved in writing within that time, plans are deemed approved. Approval shall not be unreasonably withheld.
