What Ahwatukee Rh-2's governing documents say
This is a Second Amendment to the Declaration of Covenants, Conditions and Restrictions for Ahwatukee RM-2, a single-family home community in Guadalupe, Arizona. It amends specific rules for certain lots but does not reprint the full governing documents. The rules here bind lot owners.
- Setback requirements: Front setback: minimum 10 feet from front lot line. Side setbacks: minimum 5 feet from interior side lot line, 10 feet if adjacent to a street. Carport/storage attached to dwelling may be 5 feet from interior side, 10 feet from street side. For lots bordering a golf course, no building within 25 feet of the golf course boundary. Exceptions for lots 6362–6369 as originally built by developer.
- Party walls: Walls built on the dividing line between lots are party walls. Repair and maintenance costs are shared proportionally. If damaged by cause other than owner's negligence, both owners share equal cost. If an owner's negligence causes damage, that owner bears full cost. Any owner altering a party wall must get written consent from the adjoining owner. Disputes go to the Board of Directors of ABM for binding resolution.
- Roof and exterior maintenance for lots 6360–6371: Owners of lots 6360–6361 and 6370–6371 may repair/replace common roofs without neighbor approval only if the work does not change the exterior appearance; otherwise, mutual agreement is needed, or if materials differ from original, Board approval is required. Exterior painting or color changes require mutual agreement of both owners. Costs shared proportionately; disputes resolved by Board.
- Roof and exterior maintenance for lots 6372–6375: For these four lots, roof repair/replacement without changing appearance does not need neighbor approval. If changing appearance, agreement of three of the four owners is required, or if materials differ from original, Board approval. Exterior painting or color changes require agreement of three of the four owners. Each owner pays separately for their own roof; painting costs shared proportionately. Disputes resolved by Board.
- Exclusive use easement for lots 6362–6369: A five-foot easement along the dividing wall or exterior wall of these lots is granted for exclusive use of the adjacent lot owner. The owner of the servient lot (where the easement is located) cannot use that area except for ingress/egress for repairs. No permanent structures allowed in the easement. The dominant lot owner maintains the easement area.
- What this document doesn't cover: This amendment does not address age restrictions, leasing/rental rules, pet limits, parking, assessments, architectural review (other than specific lot provisions), or amenities. For those rules, you must refer to the original Declaration and any other amendments.
