Ahwatukee E-2 is a single-family home subdivision within the larger Ahwatukee master-planned community in Phoenix, AZ. The community is governed by two associations: the Ahwatukee Board of Management (ABM) for general common areas, and the Equestrian Management Association (EMA) for equestrian trails and restricted common areas. Most lots have horse privileges, and the neighborhood is designed for equestrian use. These rules apply to all lot owners, and prospective buyers should know that the community enforces strict architectural controls, pet limits, and use restrictions.
- Who you belong to: two associations: All lot owners are automatically members of both ABM (manages general common areas) and EMA (manages equestrian and restricted common areas, including trails). Both associations levy annual and special assessments and have enforcement powers.
- Horse privileges & livestock: Most lots in E-2 (except lots 1060, 1071, 1086, 1087, 1091, 1092, 1095) allow horses, sheep, goats, or cows. Maximum three such animals per lot, with corral area limited to 5,000 sq ft on the rear half of the lot. Minimum setbacks for corrals: 120 ft from front, 8 ft from rear, 10 ft from side (15 ft on side streets). No swine, pigeons, chickens, ducks, turkeys, or other poultry are allowed on any lot.
- Pet restrictions: On non-horse lots (the seven excluded lots), only normal household pets like dogs or cats are allowed. On all lots, household pets must be kept in an enclosed yard or on a leash; enclosures must prevent escape. No animals may be kept until construction of a dwelling is complete.
- Architectural review: All construction, fences, walls, or other improvements require prior written approval from the Architectural Control Committee (initially appointed by developer, later by EMA board). Plans are deemed approved if not disapproved within 30 days. Committee must consider color, materials, design harmony, and location.
- Leasing & rentals: Leases must be in writing and the tenant must agree in writing to comply with the declaration, association bylaws, and rules. Any failure by the tenant is a lease default. No lot or dwelling may be leased without this written agreement.
- Vehicle & storage restrictions: Motorcycles and recreational vehicles (except lawn equipment and equestrian service vehicles) may not operate on walkways, common areas, or restricted common areas. Inoperable vehicles must be stored inside a garage. Boats, trailers, horse trailers, mobile homes, and campers may not remain on property for more than 48 hours unless stored in a garage or other area not visible from other lots. Garages must be used for parking and storage only, not for living or recreation.
- Signs & antennas: No advertising signs visible from neighboring property except: small residential identification signs (max two, each ≤72 sq inches), one 'for sale' or 'for rent' sign (≤5 sq ft), and signs required by legal proceedings. No outdoor television/radio antennas or other electromagnetic devices are allowed unless approved.
- Assessments & fees: Annual assessments for EMA are initially capped at $120/lot, and for ABM at $27/lot, with automatic 5% increases per year without a vote. Higher increases require a two-thirds vote of members. Assessments are a lien on the property and a personal obligation of the owner. Delinquent assessments accrue 6% interest and may be foreclosed.
