Ahwatukee T-1 is a planned community in Phoenix, AZ, comprised of single-family residential lots and townhomes with party walls. The Declaration of Restrictions (1973) and its amendment (1974) establish use rules, an architectural committee, and an HOA (T-1 Management Council) that maintains common areas and levies assessments. All owners are automatically members of the HOA.
- What you own & maintain: You own your lot and dwelling; the HOA maintains common elements (e.g., landscaped areas, streets, utilities). Interior utilities are your responsibility. Party walls (between townhome units) are jointly owned and must be repaired jointly.
- Architectural & design standards: Minimum dwelling size: 900 sq ft living area (excludes porch, garage). Exterior additions/alterations (including color changes) require written approval from the HOA board or its architectural committee.
- Leasing & rentals: All sales, leases, and subleases require prior HOA board approval. The board has 15 days to act and a first right to purchase or lease on the same terms; if no action, the deal is deemed approved. Certain foreclosure transfers are exempt.
- Pets: No livestock or poultry. Dogs and cats must be confined to your lot and not allowed to run free.
- Fencing & landscaping: Front fences/walls must not be set forward of the dwelling's front wall. Side/rear walls max 6 ft; hedges max 3 ft. On lots bordering a golf course, rear fences within 25 ft of property line max 2.5 ft (except wrought iron up to 6 ft). Landscaping must not obstruct golf course views.
- Parking & vehicles: No house trailers or campers may remain on a lot or parked adjacent for more than 48 hours.
- Business & commercial activities: No business, store, office, hospital, or theater may be conducted on the property. No advertising signs larger than 5 sq ft (except one 'For Sale' or 'For Rent' sign).
- Assessments & fees: Monthly assessments are set by the HOA board (initially $40/month per unit). An initial exterior maintenance assessment equal to 6 times the monthly rate is due at closing. Assessments can be increased by the board. Delinquent assessments become a lien on the unit.
