The Heights of Ahwatukee Custom Estates is a single-family home subdivision in Phoenix, AZ, governed by a homeowners association (AHWATUKEE CUSTOM ESTATES MANAGEMENT ASSOCIATION, or ACEMA, and the master association ABM). Owners own their lot and home; the associations enforce design standards and maintain common areas. This is a custom-home neighborhood with strict architectural controls and a minimum house size of 2,800 square feet.
- Minimum dwelling size & construction: Every dwelling must have at least 2,800 square feet of enclosed living area (excluding porches, garages, basements). Construction must be brick, cement block, or insulated frame. Only one dwelling per lot.
- Architectural review: All plans and specifications for any structure (including fences, walls, and landscaping) must be approved in writing by the ACEMA Board or its Architectural Control Committee. The Board has wide discretion and must act within 30 days or plans are deemed approved.
- Use restrictions & businesses: Only single-family residential use is allowed. No business, store, office, or commercial activity may be conducted on any lot.
- Pets & livestock: No livestock or poultry. Dogs, cats, or household pets are allowed but limited to a total of 3 dogs and/or cats per lot, must be kept on owner's property or on a leash, and not for commercial purposes.
- Parking & vehicles: No inoperable, recreational, or commercial vehicles may be parked on lots except in a garage or on a designated driveway. Boats, trailers, campers, and motorhomes are allowed only for temporary parking (up to 48 hours) and must be screened from view. Garages cannot be converted to living space.
- Assessments: Two associations levy assessments: ABM (master association) and ACEMA (custom estates association). Initial maximum annual assessment per lot is $65; ABM may increase up to 5% yearly, ACEMA up to 10% or CPI, without membership vote. Special assessments require 2/3 vote. Unpaid assessments bear 10% interest and are a lien on the lot.
- Leasing & rentals: Leases must be in writing and the tenant must agree in writing to abide by the Declaration, articles, bylaws, and rules. Noncompliance by tenant is a lease default.
- Preservation easements: Some lots have preservation easements to maintain natural desert character. No alterations are allowed within easement areas, and no vehicles may enter. A 1-foot vehicular non-access easement runs along boundaries.
