What Hallcraft Villas East I, II and III's governing documents say
This document is an amendment to the bylaws of Hallcraft Villas East I, II and III, a condominium community in Guadalupe, AZ. It sets rules for owners and tenants, including leasing requirements and penalties for violations. The amendment applies to all owners, tenants, and occupants of the project.
- Who is bound: All present or future owners, tenants, future tenants, employees, or anyone using the facilities are subject to the bylaws, the Regulatory Agreement, and the Declaration of Horizontal Property Regime.
- Leasing & rentals: Family units may be rented, but occupancy is limited to the tenant, family members, and social guests. Tenants are subject to all governing documents. Owners are fined an amount equal to the monthly maintenance fee per each tenant violation that goes uncorrected for a month.
- Owner responsibility for tenant violations: Owners are fined an amount equal to the monthly maintenance fee for each act or omission of their tenant that violates the rules, causes property damage, or adversely affects other residents. The fine recurs monthly until the violation is corrected.
- Tenant information reporting: Owners must provide the management agent with the tenant's full name and vehicle license numbers within 10 days of move-in. Failure results in a fine equal to the monthly maintenance fee per month. Existing tenants as of the amendment's effective date had 20 days to comply.
- Fines and liens: All fines described in the amendment are considered sums assessed by the Association and, if unpaid, constitute a lien on the owner's unit that may be foreclosed.
- Attorney fees and costs: If an owner defaults on assessments (including maintenance fees, special assessments, or fines) or violates any governing document, the owner must pay all attorney fees and costs incurred by the Association, including costs of suit.
- What this document doesn't cover: This is an amendment to the bylaws and does not include the full set of community rules, such as pet restrictions, architectural guidelines, parking rules, or common area use policies. Those may be in the original bylaws, declaration, or rules and regulations.
