This is a First Amendment to the Diamond Resorts U.S. Collection timeshare declaration, which governs a multisite resort program across the United States. It clarifies how the Declarant (developer/sales company) sells 'Term Points'—limited-duration use rights for resort accommodations that expire on a specified date and automatically revert to the Declarant upon expiration.
- What you own: Term Points: Term Points grant you the right to reserve accommodations at Diamond Resorts properties during a specified term — 5, 10, 30 years, or other periods the Declarant determines. You own a limited use right, not real estate or a perpetual interest.
- Expiration & reversion: On your Expiry Date, your points automatically revert to the Declarant, who notifies you of the date and can resell them to new members. You have no further rights after expiration.
- Declarant's unilateral control: The Declarant has the unilateral right to set all term lengths, create multiple categories of Term Points with varying durations, and amend the program without member consent or vote.
- What this document doesn't cover: This is an amendment only; it does not describe annual assessments, resort amenities, booking procedures, member governance, voting rights, or the full membership terms in the base Declaration.
