Eighth St. Square is a townhome (attached) community in Phoenix, AZ, governed by the Eighth St. Square Townhouse Association. Each owner owns their individual lot and townhouse unit, shares ownership of common areas, and is responsible for maintaining the interior of their unit and patios. The association maintains common areas and enforces rules.
- What you own & maintain: You own your townhouse unit and lot. You must maintain the interior, patios, and fixtures inside your unit (up to where utilities enter the walls). Termite control is your responsibility. The association maintains common areas.
- Architectural review: No exterior changes (structures, fences, additions) may be made without written approval from the Board or an architectural committee. Plans must be submitted; if no response within 30 days, approval is deemed given.
- Party walls: Walls on lot lines between units are party walls shared equally. Both owners share repair costs if damage is from neutral causes; if one owner causes damage, that owner pays. Disputes go to arbitration.
- Use restrictions: Residential use only. Pets (dogs, cats, household pets) allowed but not for commercial breeding. No temporary structures, trailers, or business activities. One "For Sale" or "For Rent" sign per parcel (max 5 sq ft). Clotheslines only in patios, garbage cans screened.
- Assessments & fees: The association levies annual and special assessments. Annual assessments can increase up to 3% per year without a member vote; above 3% requires 2/3 vote of each membership class. Unpaid assessments bear 6% interest and become a lien on the property, subordinate to first mortgages.
- Damage & rebuilding: If your unit or a common element is damaged due to your act (or your guests/tenants), you must repair within 60 days (contract) / 6 months (completion). If you fail, the association can repair and charge you, with a lien if unpaid. Disputes go to arbitration.
