What Roosevelt on 5th's governing documents say
Roosevelt on 5th is a condominium in Phoenix, AZ — you own your individual unit and share ownership of the building's common elements, which the association maintains. The community includes both residential and retail units, with separate rules for each.
- Residential & retail units: Units 2–5 are residential; Unit 1 is retail. Residential units must be used exclusively as homes, though home-based businesses are allowed if invisible from outside and comply with zoning. Retail units may be used for commercial/retail/office uses permitted by the city, but certain uses (to be specified later) are prohibited.
- Leasing & rentals: Residential units cannot be leased for an initial term of less than 30 days. Leases must be in writing and acknowledge the governing documents; the owner must provide tenant info to the association upon request. Owners are liable for tenant violations.
- Pets: Up to two dogs or two cats (or one of each) per residential unit. Pets must be leashed on common elements; owners must clean up waste. The board may ban breeds deemed dangerous or remove pets that are a nuisance.
- Parking & vehicles: Only authorized passenger vehicles (cars, SUVs, passenger vans, motorcycles, light pickup trucks) may be parked in designated parking spaces. No RVs, boats, trailers, or commercial vehicles. No vehicle maintenance on common elements. Violators may be towed at owner's expense.
- Balconies & rooftop terraces: Each residential unit has an allocated balcony and rooftop terrace (limited common elements). No furniture, plants, or storage unless approved by the board. No barbecues, open flames, spas, or hot tubs on balconies or terraces.
- Construction & alterations: Structural changes or exterior modifications to a unit require board approval. The board may require plans, insurance, and a security deposit. Changes to common elements also need approval. Work must comply with all laws and permits.
- Signs & window coverings: No signs visible from outside a residential unit without board approval. Retail unit owners may place signs on exterior walls subject to city ordinances. Reflective window films, aluminum foil, etc., are prohibited; drapes and blinds must be board-approved.
