- Well Association & Administration: A Well Association is created, initially administered by the seller (SELLER) who reads meters monthly and keeps books. The administrator is paid $10.00 per month per active well share, adjusted every 3 years per NASA Consumer Pricing Index. The seller may resign or be replaced by a majority vote of co-owners.
- Hook-up & Transfer Fees: A one-time meter hook-up or transfer fee of $350.00 applies per undivided interest (well share), payable by the first end user and each subsequent owner upon transfer. The fee is deposited into the association account, with priority for pending bills, $100 to seller, and remainder reserved for future repairs.
- Monthly Charges & Water Usage: A minimum monthly charge of $32.37 per well share begins 30 days after first water use. This covers up to 4,000 gallons per month. - Water Usage & Conservation: During severe drought or shortage, co-owners must voluntarily curtail non-essential use (e.g., non-food irrigation, car washing, swimming pools) to ensure adequate household water. Gray water systems and rainwater capture are encouraged. Water spigots must not be left running unattended.
- Non-Payment & Disconnection: Failure to pay monthly charges or capital cost shares within 30 days results in loss of water rights. After delinquency (one month + one day), the administrator sends a notice; if unpaid within 15 working days, water service may be discontinued until all amounts, costs, and legal fees are paid.
- Term & Amendments: The covenant has a 10-year term starting from first recording, automatically renewing for additional 10-year periods unless co-owners representing at least two-thirds of shares vote to let it expire within one year of expiration. Amendments require agreement of at least two-thirds of shares and must be recorded.
- Transfer & Alienation of Well Shares: Well shares cannot be further divided beyond 1/14th without written consent of all co-owners. Shares are appurtenant to the land and cannot be sold, rented, or transferred separately from the property. Upon sale of the property, the new owner must ratify the covenant.
