This is a private easement agreement between a specific property owner (Grantor) and a telecommunications company (Grantee) for the construction and operation of a cell tower on a single lot (Lot 68 of Hidden Valley Estates) within the Copper Sky area of Maricopa, AZ. It is NOT a community association rulebook — it grants exclusive rights and imposes restrictions only on that one parcel. Homeowners, buyers, or renters in Copper Sky should not rely on this document for community rules; it does not govern the neighborhood as a whole.
- What this document is: Grantor (property owner) grants Grantee (VB BTS, LLC) an option to acquire perpetual easements on the identified parcel to build, operate, and maintain a telecommunications tower, including access and utility easements. The option lasts up to 24 months; if exercised, the easements are perpetual.
- Property restrictions (on the Grantor): For as long as the easement agreement is in effect, Grantor cannot allow any other wireless tower or fiber backhaul on the parcel, cannot transfer the property to a tower company, and must not interfere with the tower's communications systems.
- Maintenance & taxes: Grantor remains responsible for general property maintenance and real property taxes. Grantee pays for tower maintenance, personal property taxes on its equipment, and must restore the property after testing.
- What this document doesn't cover: This document does not establish any community-wide restrictions, architectural rules, pet limits, lease terms, parking rules, or homeowner association fees for the Copper Sky neighborhood.
