Desert Forest Park is a single-family residential subdivision in Cave Creek, AZ, governed by a set of restrictive covenants that run with the land. These rules apply to all lot owners and are enforced primarily through an Architectural Control Committee. There is no homeowners' association or mandatory fee structure described in this document.
- Lot use & structures: All lots are designated for single-family residential use only. Only one residence per lot is allowed, with a minimum of 1,000 square feet of living area (excluding porches, patios, and garages), and a maximum height of two stories. A private garage or carport for up to two cars, attached to the dwelling, is required and must not exceed one story.
- Architectural review: All new construction, alterations, or additions require prior approval of plans and specifications by the Architectural Control Committee. The Committee may refuse approval for aesthetic or other reasons, including harmony with surroundings. If no Committee exists or it fails to act within 10 days of written request, approval is not required, but the design must be in harmony with existing structures in the immediate vicinity.
- Fences, walls & hedges: No solid wall or fence over 2.5 feet high may be placed nearer to the front street line than the front wall of the residence (or within 20 feet of the front lot line if no residence exists). Side and rear fences or walls (other than the building wall) may not exceed 4 feet in height, except patio enclosure fences up to 6 feet if located on the rear one-third of the lot. Hedges over 3 feet high are not allowed within 20 feet of the front lot line.
- Native vegetation & landscaping: Native growth, including cacti, may not be destroyed or removed except as necessary for building construction and driveway maintenance.
- Animals & commercial use: No poultry, cattle, horses, pigs, rabbits, or commercial dog/cat raising is permitted. Personal pets (dogs and cats) are not restricted as long as not raised for commercial purposes.
- Signs: No advertising signs are allowed except one 'For Rent' or 'For Sale' sign per lot. Billboards or other unsightly objects are prohibited.
- Subdivision & lot splitting: Lots may not be subdivided into smaller lots, except to increase the area of an adjacent lot (the remaining portion then becomes part of that adjacent lot). Portions may be dedicated for public utilities without violating this restriction.
- Duration & amendment: These covenants run with the land until December 31, 1990, and are automatically extended for successive 10-year periods unless a majority of lot owners agree to change them in whole or in part. Invalidating one covenant does not affect others.
