What Alamos East's governing documents say
Alamos East Unit Two is a single-family home subdivision in Mesa, AZ, governed by a Declaration of Covenants, Conditions and Restrictions (CC&Rs). These restrictions run with the land and bind all current and future lot owners. The document establishes rules for lot use, building standards, and property maintenance.
- Lot use & building type: Each lot is restricted to one detached single-family dwelling. Minimum ground floor area is 1,000 sq ft for most lots (Lots 95-181) and 840 sq ft for Lots 182–197, exclusive of open porches, pergolas, or attached garage. Construction must be masonry or insulated frame stucco with decorative redwood paneling. No structures may be moved from other locations.
- Setbacks & fences: Front wall of any dwelling or garage must be between 25 and 35 feet from the front property line. Side walls must be at least 7 feet from side lot lines (10 feet on street sides). Carports must be at least 3 feet from side lines. No solid fence over 2.5 feet high is allowed within the front setback area; side and rear fences may be up to 6 feet high. Hedges over 3 feet are not permitted within 20 feet of the front line.
- Architectural review: No structure may be built unless its design, location, and materials are approved in writing by a committee. Initially, the committee is a single person (L. J. Peden). After 75% of lots are sold, the committee is elected by a majority of lot owners. If the committee fails to approve or disapprove within 30 days of a written request, approval is not required provided the building complies with all restrictions and is in harmony with existing structures.
- Prohibited uses & activities: No livestock, poultry, or pigeons may be kept. No business, hospital, sanitarium, theatre, saloon, or entertainment venue is allowed. No advertising signs except one 'For Sale' or 'For Rent' sign per lot. No nuisances or activities that endanger health or unreasonably disturb others.
- Lot maintenance & liens: Owners must keep their lots free of weeds and trash at all times. If an owner fails to do so, the subdivider (or association) may clean the lot twice yearly and charge up to $50 annually per lot. That charge, if recorded, becomes a lien against the lot.
- Duration & amendments: The covenants initially run until September 12, 1998, and then automatically renew for successive 10-year periods unless a majority of lot owners vote to change them. The declarant (original developer) may amend or rescind any restriction until 75% of the lots have been conveyed.
