This is a Declaration of Easements, Covenants and Restrictions for the Baseline/Power commercial shopping center in Mesa, AZ. It governs uses, maintenance, and reciprocal easements among the owners of parcels within the center — primarily a Fry's grocery store (Dillon Parcel) and a developer-owned parcel with pads. It is not a residential community document.
- Type of document & community: A commercial shopping center reciprocal easement declaration, binding the owners of the Dillon Parcel (Fry's) and the Developer Parcel (pads). Not a residential HOA or condominium.
- Exclusive use rights (Fry's): Fry's has the exclusive right to operate a supermarket, drugstore, and pharmacy. No other owner may sell groceries, drugs, or operate a convenience store. Delicatessens larger than 2,000 sq ft are prohibited. A gasoline station pad may have a retail sales area up to 600 sq ft selling typical items.

- Building area & height limits: Allowed gross floor areas: Dillon Parcel 63,000 sq ft (plus future 13,200); Pad A 10,000; Pad B 3,500 with drive-through (5,500 without); Pad C 11,200; Shops Pad 11,000. Height limits: Dillon Parcel 36 ft; Pads A, B, C 24 ft; Shops Pad 30 ft; all one story maximum.
- Common Area maintenance & costs: Developer maintains common area and recovers costs via pro rata shares based on allowed gross floor area: Dillon Parcel 62.56%, Developer Parcel 37.44%. Permitted expenses include landscaping, trash, insurance, parking area maintenance, utilities, and sign costs. Excluded: real estate taxes, fire insurance, administrative overhead, late charges.
- Parking & deliveries: No parking charges unless required by government. Employee parking may be regulated; Dillon Parcel owner may use parking north of Pad B exclusively for Fry's employees. A maneuvering area for Fry's trucks must remain unobstructed.
- Signs & center name: Monument/pylon signs must comply with a Comprehensive Sign Package. The center must be operated under the name 'Fry's Food & Drug' (with 'Superstition Springs' if required), unless changed with party consent.
