What Power Square Mall's governing documents say
Power Square (Phoenix, AZ) is a commercial condominium project. This Supplementary Declaration governs Lot 1 and its units, particularly Unit 2, which is designated exclusively for self-storage facility operation. This is a partial document — the complete governing rules are in the underlying master Declaration.
- Unit 2's permitted use & exclusive right: Unit 2 is designated exclusively for self-storage facility operation and may be used for no other purpose whatsoever. So long as Unit 2 operates as a self-storage facility, no other occupant in the project may operate a self-storage facility.
- Parking: No parking fees may be charged on Lot 1. Paved and lighted customer parking areas (Tract A) must be constructed and maintained at all times to ensure free pedestrian and vehicular traffic flow through the property.
- Signage rights: The owner of Lot 1 is allocated one double-sided sign panel on each existing pylon sign located along E. Baseline Road and S. Power Road. The owner must fabricate, install, and maintain their sign panel at their own expense.
- Maintenance & cost recovery: The managing party maintains common areas per the master agreement and is entitled to reimbursement. If a party violates this declaration, the owner of Lot 1 may undertake corrective action and demand reimbursement within 30 days, plus reasonable attorneys' fees.
- Duration & modification: All rights granted continue indefinitely unless canceled; other obligations end after 99 years. This declaration can only be modified or canceled with written agreement from the owner of Lot 1, any materially affected unit owner, and the declarant (while the declarant holds an interest in the project).
- What this document doesn't cover: This is a supplementary declaration applying only to Lot 1. It does not include the complete rules for Power Square — the underlying master Declaration covers assessments, enforcement, architectural review, and other governance matters not addressed here.
