What Superstition Point's governing documents say
Superstition Point is a single-family home subdivision in Mesa, AZ, governed by a homeowners association (HOA) through this Declaration of Covenants, Conditions and Restrictions (CC&Rs). These rules apply to all lot owners and residents, binding the land and any successors.
- Architectural review: An Architectural Committee must approve in writing any exterior improvements, alterations, or repairs. Plans and specifications must be submitted; if not disapproved within 20 days, they are deemed approved. The committee is initially appointed by the developer, then elected by a majority of owners after all lots are sold.
- Use restrictions: All lots must be used exclusively for single-family residential purposes. Each dwelling must have at least 1,350 square feet of interior floor space (excluding porches and garages). No lot may be subdivided or used for commercial or industrial purposes.
- Parking & vehicles: Motor vehicles owned or in custody of an owner may be parked only in a garage or driveway on that owner's lot. Street parking is limited to approved deliveries, pickup, or short-term guests. No vehicle may be stored, neglected, or abandoned on any lot.
- Pets: Small, ordinary household pets are allowed as long as they are not a nuisance or threat. No animals, reptiles, fish, or birds may be raised, bred, or kept in any building or on any lot beyond ordinary household pets.
- Leasing & rentals: No lot or dwelling unit may be used for transient hotel purposes. Leases must be in writing, cover the entire lot and dwelling, and expressly state that the lease is subject to the Declaration. Violation of the Declaration by a tenant is a default under the lease.
- Landscaping requirements: Front yard landscaping must have at least 60% sod, a minimum of two trees, and a minimum of five shrubs. If desert landscaping is chosen, it must include at least two trees, at least seven shrubs, and no more than two cacti (limited to saguaro or other approved types). Landscaping must be completed within 60 days after a certificate of occupancy is issued.
- Term and amendment: The Declaration runs for 25 years from recording, automatically renewing for successive 10-year periods unless terminated within one year before expiration by owners of at least 75% of the lots. Amendments require a written instrument signed by owners of at least 75% of the lots, and any amendment affecting the Declarant's rights must also be signed by the Declarant.
