EastPoint is a standard single-family homeowners association (HOA) in Phoenix, AZ. You own your lot and home, and the association maintains common areas and enforces rules through assessments and an architectural review process. This document binds all owners, residents, and tenants.
- Architectural review: All exterior construction, modifications, landscaping changes, fences, and even paint colors require prior written approval from the Design Review Committee. The committee can deny based on aesthetics alone, and approval expires if work isn't started within 60 days or completed within 12 months.
- Pets: A reasonable number of dogs, cats, and household birds are allowed as domestic pets (not for commercial purposes). The board decides what is reasonable. Dogs must be leashed (max 6 ft) off the owner's lot and cannot enter other lots. Owners must clean up feces. The board may ban pets that bite or cause nuisance.
- Leasing & rentals: Leases must be for at least one month. No subleasing or assignments allowed. Owners must provide the association with tenant info at least 10 days before lease start, and the lease must acknowledge the community rules. The owner remains liable for tenant violations.
- Parking & vehicles: Parking on streets is limited if garage or driveway space is available. Commercial vehicles, recreational vehicles, boats, and trailers cannot be parked where visible from neighboring property. Inoperable vehicles must be stored out of sight. No vehicle repair visible from neighboring property.
- Signs & antennas: No signs visible from neighboring property without Design Review Committee approval (except Declarant or Association signs). Antennas and satellite dishes require committee approval unless prohibited by law; even then, installation must follow design guidelines.
- Business use: Lots are for residential use only. Home-based businesses are allowed if they are not detectable from outside, involve no customer visits or employee non-residents, and do not generate excessive traffic or parking. Leasing a home is not considered a business.
- Assessments: All owners (except Declarant) pay regular and special assessments. Regular assessments are equal per lot and set annually by the board. Special assessments require 2/3 member vote (and Declarant approval while Declarant owns lots). Delinquent assessments can lead to suspension of common area use and voting rights.
