- Building envelope & limitations: Only one single-story building is allowed on Lot 2, with a maximum floor area of 3,500 square feet. The building must be constructed within a designated 'Building Envelope' shown on the site plan.
- Use restrictions & exclusives: Lot 2 must operate as a Del Taco (quick-service Mexican food) for at least one year. Other lots in the development are restricted from operating certain competing restaurants (e.g., no other restaurant deriving over 10% of menu items from Mexican food, no bone-in chicken restaurant on most lots, and various other exclusive use protections for entities like Starbucks, Cracker Barrel, Rudy's, Noodles, etc.).
- Signage: Lot 2 may install building signage approved by the Town of Gilbert, but no free-standing signs except directional signs. Owner gets exclusive use of one-quarter of a shared monument sign and must pay 25% of monument sign costs. All signs require Manager approval.
- Parking & employees: Owner must maintain enough parking to meet government regulations and the site plan. Employees must park only on Lot 2. Failure to enforce can lead to a judicial order.
- Common area maintenance (site lighting): Parking lot pole lights on Lot 2 are powered by a meter owned by the Manager, who must keep them on from dusk to dawn (subject to force majeure).
- Amendment & notices: This supplement may be amended only by a signed writing of both Manager and Owner of Lot 2, recorded in official records. Notices to Lot 2 owner must be sent to Desert Taco LLC at a specific address and email.
