This is a Declaration of Restrictions for Chateau D'Arnett, Unit Three, a single-family residential subdivision in Mesa, AZ. It imposes covenants that run with the land, binding all current and future owners. The rules focus on lot use, construction standards, and property maintenance, but do not establish a homeowners' association or set fees.
- Lot use & building standards: All lots are for single-family residential use only. New construction must be at least 1,700 square feet of ground floor area (excluding open porches, pergolas, attached garages) and must be of masonry or insulated stucco with decorative wood paneling if desired. No buildings may be moved onto lots from other locations.
- Outbuildings & guest quarters: Garages or other outbuildings cannot be built until a dwelling house is contracted or erected. Guest or servant quarters (max 3 rooms and bath) are allowed in outbuildings but may not be rented or used for income.
- Fences, walls & hedges: Solid walls or fences must not be closer to the front street line than the front wall of the house (or 30 feet if no house exists). Maximum fence/wall height is 6 feet. Hedges or open fences taller than 3 feet are prohibited within 30 feet of the front street line. No closed fences are permitted in the front yard.
- Prohibited uses & activities: Livestock, poultry, hospitals, sanitariums, hotels, boarding houses, and lodging houses are not allowed. Mobile trailers are prohibited. No vehicle repair or rebuilding on lots or streets; vehicles may not be parked on streets indefinitely or stored on lots unless enclosed by a 6-foot solid fence in the rear yard.
- Easements & utilities: No structures may be erected on, over, or across utility easements shown on the plat.
- Duration & amendment: These restrictions run with the land until January 1, 1990, and automatically extend for successive 10-year periods unless a majority of lot owners votes to change them. Violations may be enforced by court action (damages or injunction), but do not affect existing mortgage liens.
