Cherokee Mobile Estates Unit Three is a subdivision of mobile home lots in Mesa, AZ. The property is subject to restrictive covenants that run with the land, meaning all owners and occupants must follow them. These rules govern lot use, building placement, pets, and architectural approvals. The covenants were established in 1973 and automatically renew unless a majority of owners votes to terminate.
- Lot use & structures: Each lot is for a single-family mobile home only. No tents, shacks, barns, or temporary buildings are allowed except approved accessory structures. One mobile home per lot with kitchen, flush toilet, and bath is permitted. Mobile homes must be at least 12 feet wide and have skirting and awnings installed within 60 days of placement.
- Setbacks & yards: No mobile home or building may be closer than 20 feet to the front lot line, 10 feet to any side street line, 5 feet to a side lot line, or 25 feet to the rear lot line.
- Architectural review: All plans and specifications for buildings, walls, or other structures must be approved in writing by Mohawk Credit Corporation (or a successor committee). Approval may be withheld for any reason, including aesthetic grounds. Exterior alterations also require approval. If no decision within 30 days, approval is not required, but the structure must still comply with all covenants.
- Pets: Only dogs, cats, and pet birds are allowed in reasonable numbers as pets, not for commercial use. Birds must be confined in cages; dogs and cats must be in an enclosed area or leashed. No horses, cattle, swine, goats, rabbits, poultry, or fowl are permitted.
- Maintenance & nuisances: Weeds, underbrush, unsightly growth, refuse piles, and unsightly objects are prohibited. The developer or committee may remove such nuisances at the owner's expense and place a lien. No solid wall, fence, or hedge over 3 feet on front lot lines; others may not exceed 5 feet. Fences must be cement block or chain link.
- Vehicles & storage: Boats, campers, travel trailers, and trucks up to three-quarter ton capacity may be stored in an approved enclosure or in the rear of the lot if not detrimental to appearance.
- Duration & renewal: The covenants originally ran until January 1, 1988, but automatically extend for successive 10-year periods unless a majority of lot owners records a termination before the end of a period.
